In a drastic move to eliminate LGBTQ recognition and protections, the Trump administration is in talks to legally predetermine one’s gender solely on their biology. This would ignore social identity and lived experiences, which can contrast with one’s biological parts. According to the NYT, the Department of Health and Human Services presented a memo which pushes for an exclusive definition of gender to be defined “on a biological basis that is clear, grounded in science, objective and administrable.” In other words, one’s gender could not be changed or questioned regardless of their emotional or psychological identity to that sex.
This memo is much more than a definition change on Dictionary.com. If approved, this movement would completely erase the 1.4 million Americans who identity as a different sex. Trump’s decision comes in direct contrast to Obama-era policies, which supported an individual’s choice to determine their own gender; as well as offered LGBTQ protections in the workplace, healthcare and education programs.

This is not the first time the Trump administration has tried to eradicate the civil rights of the LGBTQ community. Early on in his presidency, Trump proposed a ban on trans individuals from serving in the military, as well as take away health care protections for those who identify as transgender. The DHH is set to present its final policy at the end of the year to the Department of Justice.
